Please be aware that, by accessing the information contained on this website,
you are, by implication, accepting the following terms and conditions
established by Mining Communications Ltd (MCL).
A. USER RESTRICTIONS
This website has three levels:
Free Access. On this level, users may access* the information contain
therein without either payment or the need to register.
Registration. On this level, users must complete a simple registration
form. Data so entered must be accurate, and MCL is entitled to rely upon the
information provided. The issued User Name / Password combination will be
unique, and this code must not be shared with a third party. MCL reserves the
right to cancel website access for those users whose codes have been
compromised.
Subscription. On this level, material is only available to subscribers
of the various products, and an individual access code will be provided by
MCL's Subscription Department. Even those subscribers who are part of a Site or
Global licence (see below) will be issued with an individual, rather than
corporate, User Name and Password. These details must not be shared with a
third party, and MCL reserves the right to block website access for those
subscribers whose codes have been compromised.
On whichever level, users may not reproduce, publish, broadcast, transmit,
modify, adapt or store any material from the MCL website without prior written
permission from the company. Nor may any other website contain a link to such
material without a written agreement to this effect.
As part of the access procedures to MCL's website, users must provide an e-mail
address for occasional messages from the company (including Password
confirmation). By providing such an address, users warrant that they are
entitled to receive these messages.
* Access - the reading or downloading of material contained on this website, or
the posting of new information thereon.
B. PRIVACY POLICY
MCL is committed to safeguarding the privacy of its website users, and the
information gained during registration, and ongoing usage, will be used in
accordance with the company's Privacy Policy (see separate statement).
C. SUBSCRIPTION LICENCES
Three types of licence are available to MCL publications (in terms of both
printed and electronic products):
Individual Subscription. Access is restricted to the single person
identified at the time of taking out the subscription. However, on application,
this access can be transferred to another named person.
Site Licence. This grants the right of access to any member of staff*
whose normal place of work is the single physical address identified at the
time of taking out the subscription. (Contiguous building may also be included
in this definition.) The access itself may be from an address different from
this address but only insofar as it is a temporary business location for the
individual concerned (eg access from home or while travelling).
Global Licence. This grants the right of access to any member of staff*
of the corporation taking out the subscription.
Disclosure of the unique Username / Password code combination to any other
individual is expressly prohibited and will lead to action against the
subscriber. This action may include, but is not limited to, a withdrawal of the
services offered by MCL without financial recompense. Further, MCL reserves the
right to change these codes at any time, subject to giving reasonable notice to
the subscriber, and also to restrict access to the website if, in the company's
opinion, inappropriate use is being made of the access codes. For this reason,
MCL reserves the right to monitor usage, and must be immediately notified if a
user has reason to believe that there has been a breach of security (by
contacting it@mining-journal.com).
* Staff - Full-time employee of wholly-owned organisation within the group that
holds the corporate subscription.
D. SITE MATERIAL
Although every care will be taken in monitoring the website, MCL accepts no
responsibility for any information contained therein. Subscribers should use
particular care when accessing material provided by third parties, and are
advised to check the accuracy of such information before acting on it.
E. USER LIABILITY
By accessing this website, you agree to indemnify MCL against all liabilities,
costs, claims and expenses which either party may suffer in consequence of any
breach of this agreement or of use of the material contained on the website.
MCL accepts no obligation to maintain the website, excepting that, on permanent
closure of any internet feature, it will repay any outstanding subscription fee
that pertains to that particular service (payable from the date of cessation to
expiry of the subscription). This does not apply to internet services offered
in addition to a printed service.
Although MCL uses a reputable on-line banking service, the company cannot
guarantee the security of credit card payments. To minimise problems, MCL
should be advised of any discrepancies and/or concerns.
Use of this website is governed by the prevailing UK laws, and is subject to the
jurisdiction of the British courts.
F. REFUNDS AND CANCELLATIONS
Money-back guarantee - If you are not completely satisfied with your
subscription and notify us within 30 days, we will give you a full refund. If
you wish to cancel at any time after that during the lifetime of your
subscription, you will receive a pro-rata refund.
